Here are terms and conditions of Erioquest online shop as of 17 Mar. 2008. The terms and conditions written in this page are applied only to orders of customers who stay out of Japan.

Plants

Plants not covered by CITES can be shipped overseas so we offer only such plants in our catalog pages in English. All the plants are shipped bare root due to the plant export regulation.

Price, minimum order

Prices of our offerings are presented in Japanese Yen (JPY).

Minimum order of plant is JPY 5,000 in plant material.
There is no minimum order if just seeds are ordered.
Minimum order of postcards is four post cards yet, you can order fewer postcards as long as you are 18 years old or younger.

Stocks, substitutions

We always do our best to fulfill every submitted order but our offerings can be out of stock mainly due to following reasons:
(1) somebody else paid for the items before we receive your payment,
(2) items are damaged or lost in disasters or extreme climatic conditions,
(3) plants are damaged or lost by pests, infections or other holticultural troubles,
We will ask you before processing the order if any of these problems occur. We will not substitute items without your evident agreement but will try to introduce some substitution candidates which you can view on our website.

In the case substitutions are not accepted or we are not able to arrange them, refund can be made with JP or US bank notes or with Paypal if available.

Import regulations

A phytosanitary certificate can be added to your order at JPY 1,400 and it is the only certificate that we can supply related to import regulations. Of course, we can ship plants with or without phytosanitary certificate on your request.

Prior to placing an order you should assure that your country permits you to import the plants. On the other hand, if we are not sure what kind of papers we should attach, we will ask you instead of your country's customs. If you have something to instruct us about the matter, don't hesitate to let us know.

Shipping and handling charge

Shipping and handling charge varies depending on delivery methods and contents of your order.

1. Plants with or without seeds
Your order will be shipped in a parcel, then shipping and handling charge per parcel will be a flat JPY 2,400 by airmail or a flat JPY 3,400 by Express Mail Service (EMS). Seed packets can be packed with plants so there is no additional charge for seeds.

2. Seeds only
Things are a bit complicated about seed only orders. If an order consists of 10 or less seed packets we can pack them in a cushioned envelope. In such cases the shipping and handling charge will be reduced to JPY 500 by airmail or to JPY 1,500 by EMS.

In conditions below we use a parcel to ship seed packets so the shipping and handling charge will become the same as that of a parcel:
(1) order is larger than 10 seed packets,
(2) you request us to pack seed packets in a parcel.

3. Postcards
Postcards will be usually sent by airmail. They are processed as a practically different order from plants or seeds, so we offer the shipping and handling charge for postcards independent of the other kinds of ordered materials.

The charges are described at the table below. We offer different charges for three different areas of the world in order to cut down the shipping charges as much as possible.

In the case you put postcards and plants into one order, the postcards will be packed in another envelope and then shipped at a different time, earlier than plants.

Payment

Payment must be made before we process an order. Payment can be made with international money order(IMO) or Paypal in Japanese Yen. We are not able to handle credit card facilities directly at the present.

Process

Orders will not be processed before payment is confirmed. Once payment is confirmed we process orders on a first come, first served basis.

Postcards will be shipped within 5 business days from confirmation of payment. It will take usually 2 weeks to ship an plant order from confirmation of payment yet the processing period may vary depending on circumstances of our business. If processing period is getting lengthy you will be notified about it.

If a phytosanitary certificate is added to an order, we may need another couple of weeks to prepare the papers.

Delivery

We are ready to ship our offerings out of Japan to any countries where our parcels can reach by airmail or EMS. Each delivery goes at your risk as we will not take any responsibility for any problems which may occur after we post parcels.

Once items leave our country we have no way to control any import issues or transport problems thus we cannot take any responsibility for delay, loss or any other issues which may occur on your country.

Unpacking

As soon as you receive parcel unpack it and check items' condition, then please let us know if there are problems caused by our side, e.g. wrong quantity, different items etc. Though we guarantee secure packing as well as good quality of items at shipping, we cannot take any responsibility for damage or loss resulting from delay, loss or any other problems which may occur on your country.

Replacement

We are ready to replace wrong or damaged items. However, we will do so as long as such issues are evidently caused by our handling or packing of the order. Replacing items will be shipped free of charge by airmail.

It is often difficult to replace with the same kind of items due to the nature of our offerings. In such cases you will be asked about replacement with other stocks or refund, in JP or US bank notes or with Paypal.

Return

You can return ordered items in first seven days of their arrival. Returned items must stay unchanged and whose wrappings are not broken. You can return a whole order if nothing inside the package is changed, damaged or lost. Then the refund will be made solely for items but the other charges, including shipping charge you pay, will not be refunded at all.

If you decide to return items or an order, please let us know and make an agreement of the return. The refund will be made in JP or US bank notes or with Paypal, just after we receive and check the return.

We will not accept return of items which get any modifications after our shipping. Neither will we accept return of items which does not have a prior agreement of the return or which arrives bypassing needed investigations. In such cases the return will be rejected or destroyed at once and the refund will not be made at all.

Cancel

You can cancel orders anytime before you make payment. If you decide to cancel your order please let us know by e-mail ASAP. Once payment is confirmed the order cannot be cancelled for your reasons.

If your payment are not confirmed in a couple of weeks after we send order receipt e-mail to you, such an order will be cancelled automatically unless you get an agreement with us about the payment delay.

Changing of the terms and conditions

These terms and conditions are subject to change without notice. Please check them every time before you place an order because you will be considered to accept the terms and conditions at the time when you send an order form.
